The Government of Islamic Republic of Afghanistan has received financing from the World Bank toward the cost of Afghanistan Gas Project (AGASP), and intends to apply part of the proceeds for consulting services.

The consulting services (“the Services”) include International Business Development Consultant (International) The consultant will be responsible to work under close supervision of the Minister as well as Senior Technical Mining and Environmental Adviser, and will work closely with other advisers in the AGS, the Large Scale Mining Unit (LSMU) and colleagues in the MoMP on the development of prospective large mining contracts and other extractives activities in order to address the challenges and opportunities for the development of a streamlined tender and contracting process for the extractives sector in Afghanistan in line with international best practice. The detailed scope of services is indicated in the attached TOR.

The Ministry of Mines & Petroleum now invites eligible individuals (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services (to attach cover letter and curriculum vitae with description of experience in similar assignments, similar conditions, etc.). The criteria for selecting the Consultant are:

  • Masters’ Degree or equivalent in law, economics, mining economics, economic geology or business administration.
  • At least a total of 15 years of experience in the extractives sector, preferably as a senior policy maker in government related to fiscal planning, royalties and regulation, and including experience working in Afghanistan as well as following areas:
    • Management and development of extractives sector legal frameworks including regulations and contract tendering
    • In project management and capacity building, including advising senior policy makers at an executive and cabinet level.
    • Detailed knowledge of international extractives industry standards and the working relationship between the private sector and the public sector
  • Working with an international organization in the extractives sector related to contract negotiation and regulatory affairs.

Desirable

  • Have regional experience, particularly in Afghanistan.

The attention of interested Consultants is drawn to paragraph 3.14, 3.16 and 3.17 of the World Bank’s Procurement Regulations for IPF Borrowers, July 2016 (“the Regulations”), setting forth the World Bank’s policy on conflict of interest.

Job Summary:

The Ministry of Mines and Petroleum is seeking for an international consultant to advise the Ministry on the development of extractives projects.  The consultant will be responsible to work under close supervision of the Minister as well as Senior Technical Mining and Environmental Adviser, and will work closely with other advisers in the AGS, the Large Scale Mining Unit (LSMU) and colleagues in the MoMP on the development of prospective large mining contracts and other extractives activities in order to to address the challenges and opportunities for the development of a streamlined tender and contracting process for the extractives sector in Afghanistan in line with international best practice.

Skills Required:

  • Policy and regulatory experience in the extractives sector;
  • Experience in extractives sector contract negotiations;
  • Experience in extractives sector contract compliance monitoring;
  • Project management areas of knowledge (e.g. financial planning, time management, communication management and stakeholder management);
  • Negotiation skills;
  • Analytical skills;
  • Experience working on multinational teams and across technical sectors;
  • And Excellent diplomatic and negotiation abilities.

Skills description:

  • Good knowledge of project management, utilizing project time management and communication to effectively address the tendering and contracting of large mining projects.
  • Ability to work within the team and provide support and advice related to contract tendering, negotiation and project development of large and small-scale mining projects.
  • Good communication skills in writing, editing and speaking
  • Ability to participate in discussion and operate as part of a multinational team.

Travels: As required

Duties & Responsibilities:

  1. Providing advice and support on regulation, policy matters and contract negotiations to the MoMP as needed.
  2. Working with the Task Force to coordinate the work being undertaken with respect to project development and strategic planning in the mining sector at MOMP.
  3. Support MoMP in coordinating the policy and technical advice being provided to the Minister to ensure that it is integrated into overall strategic planning and policy development for hydrocarbons and mining for the MoMP.
  4. Provide technical advice and support in the matters related to projects that includes bidding processes, contract and post contract management;
    1. Analyze the financial aspects of mining companies (e.g. general financial plans, financial proposals, finance sources analysis, financial suitability – royalty and financial capability, loan etc.)
    2. Provide support in terms of financial issues to the large-scale mining unit (LMSU) including bid and performance bonds analysis, taxation, royalty analysis.
    3. Analyze the social aspects in the mining project proposals that includes social plan analysis, expropriation analysis, conflict resolution analysis and raise the social concerns to the LMSU.
    4. Assist the Minister in developing targeted strategies to promote development of the hydrocarbons and mining sector
  5. Providing technical support in development of LMSU templates/procedure (e.g. RFP, Model Contract, Scoring Matrix etc.) and other post contract technical documentation.
  6. Undertake collaborative work with other advisers and MoMP colleagues on a variety of projects in the extractives sector.
  7. Provide support to develop a promotion and marketing strategy for the Ministry both through direct project promotion to prospective investors and wider marketing opportunities at industry trade shows, including but not limited to PDAC and the Dubai Mining Show.
  8. Provide support in the evaluation of the mining projects’ proposals.
  9. Performing any other tasks assigned by the MoMP authorities.

Confidentiality
       The Consultant agrees to keep confidential all information that it receives, directly or indirectly, from the Afghan Government, its agencies or ministries, or any other source, as well as all reports, briefs and opinions prepared by the Consultant, or by third parties, on the basis of such information (collectively, the Material). The Consultant will use the Material exclusively for the purpose of preparing deliverables relevant to this assignment as requested by the Government of Afghanistan and/or the Ministry of Mines and Petroleum. The confidentiality obligations will not apply to information in the public domain
