Job Summary:

The Senior Legal Specialist will be responsible for the legal corporate affairs of the companies working with TAPI Gas Pipeline Project and Tax and Custom matters in the territory of the Islamic Republic of Afghanistan. The Senior Legal Specialist will be writing memos and legal opinions on corporate affairs, tax and custom issues and proposing solutions, in case of standstill situations. He/she will be communicating corporate issues and other legal matters with TPCL and stakeholders of TAPI.

Duties & Responsibilities:

The Sr. Legal Specialist will be responsible for assisting TAPI Project Director and Afghanistan’s team of TAPI mainly for the following issues:

 Advising in legal and procedural requirements for finalization of transit fee, putting taxes tariffs, and custom duties on goods and machineries of TAPI Pipeline.

 Providing accurate information on issues of tax and custom duties on projects similar to TAPI for Afghan counterpart.

 Communication with corporations working on TAPI Project in Afghanistan on issues of corporate affairs.

 Communication with local and law enforcing bodies regarding legal matters and communicating the issues of tax, custom duties, tariffs, and transit fees with governmental related departments.

 Legal assistance and cooperation with project consultant(s).

 Getting/collecting and presenting all the necessary documentation to the related departments of Afghanistan during the resettlement and compensation related lawsuits.

 Helping the clients to achieve their business goals while meeting the legalities bound by agreements of TAPI and Afghanistan Law.

 Liaising with relevant organizations to discuss any vague points of related issue.

 Providing legal advice and technical feedback on legal documents of the TAPI Gas Pipeline Project.

 Preparing/drafting legal documents/memorandums.

 Preparing reports to keep the office and stakeholders up-to-date on the legal issues of the project.

 Recording and keeping confidential all the documents, information and issues of the TAPI Project Office.

 Perform other duties as assigned by the supervisor

Job Requirement:

At least Bachelor Degree in Law or equivalent. The holder of higher degree will be having the priority for selection. The knowledge of aspects of bankruptcy, law on limited liability companies, law on state owned corporations, private investment law, tax law, income tax law, intellectual property rights, Land laws, licensing and the laws specific to the business of Ministry of Mines and Petroleum and strong knowledge of Afghanistan’s law are essential for this position.

At least 7 years of experience in field of legal works including the multinational agreements with Bachelor Degree and 5 Years relevant experience with Master Degree.
